"They served you!" What does it mean?

They served you! These three words are not only familiar, but have gained notoriety over the years. People are afraid that the mother will mention these words. But what does it really mean?

It has been said that understanding is the key to erasing fear. Generally, service of process involves two parties on opposite sides and a legal act connecting the two parties. Specifically, the two parties are the one that notifies the process or the one that caused the process to be notified and the other is the intended recipient of the process. It is the recipient of the process who is usually “afraid” to hear the “you were served” line. But saying those very words means success for the other party.

“You were served” basically means that one of the parties has learned that a lawsuit has been filed against him or her. Since a lawsuit is usually seen as a nuisance or glitch in everyday life, it is avoided, evaded, dodged, dodged, and in many ways dodged in various imaginative ways.

Avoid drama during personal service or process delivery

The best way to serve any legal process is by personal service or service, which can be done by delivering the actual physical process or documents to the person named in the documents. This means that the server will have to meet face to face with the person named in the legal documents to be served.

In most cases, once a person has been served with legal process, they receive it without much fuss. The server will write the date and time of service on your copy of said legal process. Service of process is then completed and the person named in the process is now within the jurisdiction of the court that issued the process.

However, in certain rare cases, as there is a face to face meeting or a confrontation, in many circumstances it becomes a bit dramatic. This happens when the notified person refuses to receive it, and the notifier insists on receiving the same papers. The inherent situation is a potential conflict zone.

In this case, a process server with good communication and social skills will be able to serve the legal process with as little difficulty as possible. It must be understood that the initial reaction of any person to any legal process is to deny, reject and then flee. Thus, a process server who can serve the papers in the most calm and friendly manner will overcome this initial rejection.

Time is also a factor in personal service. Time, when combined with prior research into the personality and behavior of the person to be served, will yield a high success rate and eliminate the risk of conflict. Most people would keep any hint that they are being sued a secret. That is why it is important that any subpoena, demand letter or any legal document in this regard be served on you privately. This would remove the burden of explaining to any companion you may have at the time of service why such a process is being given.

In the event that the recipient continues to refuse service of process, the server must attempt service at least two more times. Serving process at least three times would constitute reasonable diligence and could be a strong basis for requesting substitute notice, which is another method of process service.
